Former US President Donald Trump has revoked the Artificial Intelligence (AI) safety guidelines introduced by his predecessor, Joe Biden. This decision marks a significant departure from the previous regulatory strategy and positions the US within an international context characterized by differing approaches to AI development.
Biden's Executive Order 14110, issued in October 2023, established the first binding safety standards for US companies developing AI. Key aspects of the order included the obligation to disclose safety test results to the government and the development of standards for digital watermarks to identify AI-generated content. These measures aimed to ensure the safe and trustworthy development and use of AI.
Trump rescinded this order shortly after taking office. The reasons for this decision were not explicitly stated. The revocation of Executive Order 14110 means that there are no longer uniform safety regulations for AI at the federal level in the US. Only inconsistent regulations at the individual state level exist.
In an international comparison, the US now stands in contrast to the European Union, whose AI Act represents a comprehensive regulatory framework for AI development. The EU's AI Act adopts a risk-based approach and classifies AI systems according to their potential for harm. High-risk AI systems are subject to strict requirements, including transparency obligations, data protection regulations, and adherence to human rights.
China pursues a different approach. The government primarily focuses on promoting AI development and intervenes mainly in content control. While safety standards play a role, they are not at the forefront of the state's strategy.
Through deregulation, the US now positions itself as a country with largely unregulated AI development at the federal level. This could accelerate global competition in the field of AI but also carries risks regarding safety and ethical aspects.
The deregulation could particularly benefit companies like xAI, the AI company founded by Elon Musk. Musk, a close confidant of Trump, has repeatedly spoken out against government regulation. Without Biden's safety requirements, the development of large language models could proceed faster and with fewer restrictions.
For other US companies that prioritize safety, deregulation could create competitive pressure. They might be forced to take more risks to keep pace with less cautious actors.
The revocation of the AI safety guidelines also raises questions about the future role of the US in the international debate on AI ethics and safety. It remains to be seen how deregulation will affect the development and deployment of AI in the US in the long term.
